Product Availability and Prices:
Milky Smile will attempt to make available all products advertised on this website, however, availability can not be guaranteed and Milky Smile will not be liable for any products which are not available at the time of order. If the product is not available, the customer will be advised as soon as possible.All prices on this site are exclusive of postage and handling charges. These prices are subject to change without notice. Milky Smile reserves the right to refuse or cancel orders where there has been an error on the website, technical or otherwise, and the incorrect price has been displayed. The customer will be notified immediately if such a situation arises and any incorrect credit card payments already received will be refunded.
By purchasing this product you agree that:

-The impression will be taken by you and the custom-made trays will only be as accurate as the impression taken. Milky Smile will not be liable for trays that don't fit due to a poor impression.
-Your teeth are in good condition. The teeth are not decayed or loose. All restorations are in good condition and are not loose or defective. You do not have periodontal disease or any other preexisting dental conditions that could be aggravated from use of our product.
-You have read and understand the side effects of using teeth whitening gels as advised on the “Frequently Asked Questions” page of this website.
-You acknowledge that the whitening products will not whiten any existing dental restorations. This includes, but is not limited to, all fillings, crowns, veneers, bridges.
-You have read the list of ingredients of the products purchased and are not allergic to any of them.
-You will not use the products if you are allergic to any of the ingredients. -Liability is limited to the cost and amount paid to purchase the product.
-You will not use the products if you are diabetic as some products contain sugars. -You will not use the product if you suffer from a heart condition.
- Will use the trays for the sole purpose of whitening your teeth.
- Will not use the product if you are pregnant or nursing until you have consulted with your dentist.
- Will take the impression yourself.
- Don't have loose crowns or periodontal problems (gum disease) or veneers.
- Will consult with your dentist prior to use and if you experience any problems while using this product.
- Acknowledge that this will not whiten any dental work (crowns, veneers, cavities, bridges, etc.).
- Acknowledge that employees/staff of Milky Smile are not dentists.
- Are not allergic to sodium fluoride, carbamide peroxide, glycerin, carbome, sodium hydroxide, flavor, hydrogen peroxide, ammonium, hydroxide, and silicone.
- Milky Smiles only guarantees that which is in writing (no implied guarantees) and does not guarantee against tooth sensitivity, nor against trays that don't fit due to a bad impression.
- Customer agrees that the total liability is limited to the amount of the product
- Understand that the owner of this website MilkySmile.com.au is not the manufacturer, only a reseller.
Teeth Whitening Disclaimer:
The degree of effect of the whiteness will vary from patient to patient, depending on the structure of the teeth, the number of applications, or the duration of time that the system is used. Teeth whitening may result in a blotchy appearance to the tooth surface and the whitening may not be uniform giving the teeth a banded appearance. Whitening fades with time and any unexpected results may be reversible. By ordering a product from Milky Smile you accept all the risks associated with teeth whitening and agree that Milky Smile will not be liable for any unexpected whitening results or complications that may arise as a result of the use of any products ordered through this website.
International buyers – please note: Import duties, taxes, and charges aren’t included in the item price or postage cost. These charges are the buyer's responsibility. Please check with your country's customs office to determine what these additional costs will be prior to buying.
If you wish to purchase a product from the Milky Smile website you will be asked to supply information to enable this transaction to be completed. In supplying this information you agree the information is complete and accurate at the time of purchase. You agree to pay all charges incurred to purchase this product including any shipping and handling charges as advised at the time of purchase. Milky Smiles accepts PayPal, Cash and Money Orders via mail. No cheques or C.O.D.
Due to the nature of this product results vary greatly person to person depending on the type of stains the users has, it may take up to three months to completely rid tough stains and therefore we are not able to refund purchases unless the product is defective. Milky Smile does offer a 7-day exchange back guarantee for all DEFECTIVE items provided that the product is returned in its original box and includes all original packing material, original manuals and instructions, and any accessories that came with the item. Partial returns will NOT be accepted. You will be responsible for return freight charges.
Products are only considered DEFECTIVE if any of the following is present:
-The Syringe is damaged or does not function properly.
-Mouth Guard is damaged/broken BEFORE being placed in hot water.
On returns of defective products, Milky Smile requires that you obtain a return authorization (RMA) number. To do this send an email to us vis the Contact Us link with your order number and reason. Returns without a RMA number will not be accepted. To obtain an RMA number, the purchaser is required to provide the sales order number and the reasons of return. Please reference your RMA number on the outside of the box. We recommend that you use Express Post with Australia Post.
